This paper discuuses the dynamis discourse of fiqh mu'amalah towards to consept of shari'ah banking. The existence of shari'ah banks needs to be critisized from the vierws of whether the consept used is socially beneficial; whwther it is suitable with the intended goals or even contradictive. For example, is the consept of dividing gains and riks complient or consistent with the intention of achieving social justice or not. To make it perfect, furthermore, shari'ah banks should be open to receiving any input which will develop the shari'ah banks. In this case, the shari'ah based banks can learn from capitalism which is always responsive to any critisms. In that way, shari'ah based banks may become par exellence in line with the advancement of modern era.
